General Terms and Conditions of the internet store www.zuppashop.com

INTRODUCTORY PROVISION
These General Terms and Conditions (hereinafter referred to as the "GTC") are valid for purchase in the eshop www.zuppashop.com. The GTC detail and clarify the rights and obligations of the seller as the operator of the eshop www.zuppashop.com and the buyer. These GTCs form in their up-to-date version the content of the purchase contract concluded between the seller and the buyer.

Buyer: You (the "Buyer")
 
PURCHASE ORDER
All orders created on www.zuppashop.com are binding for both parties. By sending the order, the buyer confirms that he has become familiar with these GTC and agrees with them. The buyer confirms that he is aware that sending the order gives him an obligation to pay the purchase price. Receipt of the order will be confirmed by the seller by sending a confirmation e-mail. Sending a Purchase Order Notice to Buyer creates a Purchase Agreement between Buyer and Seller. The Seller reserves the right to cancel the buyer's order if he is unable to deliver the goods for sale. The Seller reserves the right to cancel the buyer's order if the order is not paid within 7 days. On canceling the order, the seller shall immediately inform the buyer by telephone or e-mail. In case of payment of the purchase price or part of it, the buyer will be repaid within 15 days to the account from which he made the payment, unless otherwise agreed.

PRODUCT PRICE
The price of the goods is stated as a unit price for each product separately. All product prices are listed in the final price with VAT. The price of the goods is added to the shipping cost according to the chosen delivery method. Both the seller and the buyer are bound by the product prices at the time of the purchase contract. However, the seller is always entitled to rebate on purchased products in accordance with their current pricing policy or marketing campaign.
 
PAYMENT METHODS
The buyer may make a payment by a Credit Card or by PayPal. Goods will be shipped once the money have been credited to our account.
 
SHIPPING CONDITIONS
Worldwide shipping. The price for shipping within the European Union is differs from EUR 5.90 to EUR 9.90 depending on the country, rest of the world EUR 19.90
 
DELIVERY TIME
The order processing time within EU is standard up to five business days from the date of the order receipt, rest of the world within 15 business days. The seller shall inform the buyer by e-mail about the dispatch of the order. If the goods or mailing notification is not delivered to the buyer within 7 days after sending the seller's e-mail, the buyer is authorized to contact his mailing address as well as the seller at info@zuppashop.com. The seller is not responsible for the delayed delivery of goods by mail or by post. courier service, or damage to goods caused by post or, respectively, courier service. The seller reserves the right to extend the delivery period in the event of unforeseen circumstances. The purchaser will be informed of such an extension of the delivery period.

REPAYMENT OF COSTS IN CASE OF NON-RECEIPT UP OF THE GOODS
The seller has the right to reimburse the costs (damages) if the buyer has not received the ordered goods delivered to him and the buyer did not cancel the order, nor has not withdrawn from the contract. In determining the amount of damages, the seller takes into account, in particular, the transport costs and associated charges in the case of dispatch of goods, the costs associated with the packing, dispatching and administration of the order, as well as all other costs incurred by him in carrying out the order in question. Buyer is liable to pay the seller actual damage as well as indirect damages and lost profits.
 
WITHDRAWAL FROM THE CONTRACT AND RETURN OF GOODS
The seller is entitled to withdraw from the purchase contract due to the impossibility of delivering the goods to the buyer within the time limit specified in these GTC, even if all efforts that can be fairly demanded from him are not able to deliver the goods to the buyer. The reasons for the impossibility of delivering the goods to the buyer are caused by the sale of the stock or the unavailability of the goods, or if the manufacturer, importer or supplier of the goods agreed in the purchase contract interrupted the production or also made significant changes that prevented the seller from fulfilling his obligations under the purchase contract. The seller is obliged to inform the buyer about this fact and return the already paid purchase price for the goods agreed in the purchase contract within 15 days of the notice of withdrawal by transfer to the buyer's account.
The buyer is entitled to withdraw from the purchase contract without giving any reason within 14 days of taking over the goods. Buyer has the right within this time to unpack and test the goods in an appropriate manner, common for shopping in classic store. Testing for the purposes of these GTC does not mean to start using the goods and then return it to the seller. Returned goods, especially swimwear, must not be used (that is, not worn, only tested), or washed - must not be damaged or dirty - with complete tags, otherwise replacement or return will not be possible and the goods will be returned. The buyer may send a notice of withdrawal to the seller in paper together with the goods. The buyer may use the following template to withdraw from the contract. The seller will acknowledge receipt of the notice of withdrawal.
The seller shall return to the Buyer no later than 14 days from the date of delivery of the notice of withdrawal all payments received by him or her under the Contract. The seller is not obliged to pay additional costs to the consumer if the consumer explicitly opts for a different delivery method, such as the cheapest normal delivery method offered by the seller. Additional costs are the difference between the delivery costs chosen by the consumer and the cost of the cheapest normal delivery method offered by the seller. If the seller provided free shipping by the original order due to the achievement of the minimum set value of the order, but after withdrawal from the contract, the total value of the order no longer reaches this amount for free shipping, the seller is entitled to bill the buyer for shipping costs according to the selected mode of shipping. However, the seller is not obliged to return the payment to the buyer before the goods are delivered to him / her or until the buyer shows the goods back to the seller. The buyer is obliged to send the goods back or hand it over to the seller or the person authorized by the seller to take delivery of the goods within 14 days from the date of withdrawal. The goods must be returned in undamaged condition, without any signs of use or wear, in the original package, accompanied by a proof of purchase, by sending it back within the specified time limit to: ZUPPA design s.r.o., Lesna 12, 900 44 Tomasov, Slovakia. Buyer is liable for damage incurred on returned goods in respect of any impairment of the value of the goods as a result of handling it other than what is necessary to ascertain the nature, characteristics and functionality of the goods. Buyer bears the cost of returning the goods to the seller due to his resignation.
 
CLAIMS AND WARRANTY
Only goods purchased from the seller and owned by the buyer can be claimed.
If the buyer is a consumer (a natural person who does not carry out his / her business, occupation or profession), a 24-months warranty period is applicable to all products offered, unless otherwise specified, and begins on the date of receipt of the goods by the buyer. If the buyer is not a consumer, he proceeds in accordance with the provisions of the Commercial Code and the warranty period is 12 months and begins to run on the date of receipt of the goods by the buyer.
The seller is responsible for the defects of the goods under § 622 and 623 of the Civil Code, as amended. The buyer is obliged to file a claim to the seller immediately after the defect is discovered. The buyer can claim the claim either in paper form or electronically at the following e-mail address: info@zuppashop.com. Each order is accompanied by an invoice - a proof of payment for goods, which also serves as a warranty card. The returned goods, together with a proof of payment of the goods and a description of the defect, will be sent or delivered personally to the following address: ZUPPA design s.r.o., with the seat of Lesna 12, 900 44 Tomasov, Slovakia. Relevant reason for the return of goods is not the wear and tear of the goods, which naturally alters the appearance of the product. The seller will acknowledge receipt of the complaint notice without delay by sending the confirmation to the buyer's email address. In the case of a legitimate complaint, the seller commits to reclaim the claim within 30 days of delivery and to provide the buyer with proof of equipment.
Liability for defects does not apply to cases where the defect has occurred due to: a) mechanical damage to the product caused by the buyer, b) misuse of the product in a manner other than that stated in the instructions for use, c) use of the goods under conditions that do not correspond to their own d) neglect of care and maintenance of goods, e) excessive damage to goods, f) use of goods in contravention of the conditions stated in the documentation, general principles, technical standards or safety regulations or other breaches of warranty g) force majeure or natural disaster, h) normal wear and tear of the goods (or parts thereof) caused by the use of the goods.
 
DURATION OF THE CONTRACT
This Agreement shall be concluded for a specified period from the date of receipt of the Purchaser's order by the Seller until the date of fulfillment of all obligations of the Contracting Parties arising out of the Contract.

PERSONAL DATA
When ordering goods and services on the www.zuppashop.com, the Buyer is obliged to state the correct and true all necessary data, including personal data. The details entered in the user account are obligatory for the buyer to protect against third parties, and to update any change without undue delay. The buyer is responsible for the truthfulness and correctness of the data provided.
The seller processes the buyer's personal data in accordance with the Act no. 18/2018 Z. z. on the Protection of Personal Data and on Amendments to Certain Acts as amended.  Privacy Policy (GDPR) is mentioned in detail here.
 
FINAL PROVISION
These GTC apply as stated on www.zuppashop.com on the day of the electronic order submission, unless otherwise agreed. The seller reserves the right to change the GTC even without prior notice from the buyer. By submitting the electronic order, the buyer accepts without reservation all the GTC provisions in the wording valid on the day of dispatch of the order as well as the valid price of the ordered goods and shipping charges. The relevant legislation of the Slovakia applies to relations arising from the purchase contract and these GTC. If the consumer is a party to the contract, relations governed by these GTC are governed by the Civil Code and by Act no. 102/2014 Z. z. on consumer protection when selling goods at a distance or out of the premises. If a party is a non-consumer business, relations governed by these Business Terms and Conditions are governed by the Commercial Code. Any disputes arising under this Agreement will be settled before the General Courts of the Slovakia. Disputes can also be solved by so-called an alternative solution in the sense of Act no. 391/2015 Z. ..
